Italian Groceries For A Year” Official Contest Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

The Contest (the “Promotion”) will begin at 12:00 a.m. Eastern Time (“ET”) on November 15, 2009 and end at 11:59 p.m. ET on February 1, 2010 (the “Promotion Period”). Participation in the Promotion constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. The Promotion is sponsored by George DeLallo Co., 938 South center Avenue, Mt. Pleasant, PA, 15666.

1) ELIGIBILITY:

To take part in the Promotion, participants must be legal residents of the U.S., registered members of the Delallo website, and be 18 years of age or older. Employees, officers, and directors of George DeLallo Co. and any of its respective affiliated companies, subsidiaries, distributors, dealers, advertising and promotion agencies, any and all other entities directly associated with this Promotion, as well as the immediate family members and members of the same household of any of the above are NOT ELIGIBLE to participate. All federal, state and local laws and regulations apply.

2) HOW TO ENTER:

To enter the Promotion, go to  HYPERLINK "http://www.delallo.com" www.delallo.com Follow the directions there to become a registered member of the site if you have not previously done so. Submit your recipe for an Italian dish, and upload a photo of the finished dish (photo file size not to exceed 500k maximum file size.  Formats accepted: JPG, GIF, JPEG, or PNG ). Submissions must meet the criteria outlined in these official contest rules (See #3 below). By entering the Promotion, participants agree to grant the Sponsor the right to use recipes and photos submitted in publicity and/or marketing efforts in perpetuity with no notice, further permission from, or compensation due the entrant. By entering, participants agree that the Sponsor has the right to post the recipe, photo, first name of the entrant and state of residence on publicly accessible areas of the Sponsor’s website.

3) ENTRY CRITERIA:

For acceptance into the Promotion, recipes submitted must include one (1) or more DeLallo products as ingredients; see a complete listing of DeLallo products at HYPERLINK "http://www.delallo.com/catalog"www.delallo.com/catalog.  Recipes must specify which ingredients are DeLallo products. Recipes must list precise preparation instructions and exact quantities of all ingredients in U.S. measurements. Recipes must not list any brand names other than DeLallo. Accompanying photo of prepared dish must not depict packaging or brand names other than DeLallo.

Use of computer programs to enter and/or other automatic entry methods, (such as hacks or bots), are  strictly prohibited. Sponsors reserve the right to disqualify, block or discard any entries from any individual who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with the entry process as determined by the Sponsor in their sole discretion. Suitability of entries for acceptance into the promotion shall be at the sole discretion of the Sponsor, who reserves the right to reject any entry deemed by the Sponsor to be in any way unsuitable.

4) JUDGING CRITERIA

All accepted entries will be scored according to the following judging criteria: 1-50 points for creativity of the recipe, and 1-50 points for visual presentation as demonstrated in the submitted photo. The ten (10) entries with the highest scores will be named as finalists; these ten recipes will be prepared and judged for taste on a scale of 1-25.

5) PRIZES: The entry with highest score for taste will be named the Grand Prize Winner and will receive approximately $150 worth of Italian groceries per month for one (1) year. The next three (3) highest-scoring entries will be named the First, Second, and Third Prize Winners respectively. The First Prize Winner will receive a Delallo gift collection worth approximately $500.  The Second Prize Winner will receive a Delallo gift collection worth approximately $250.  The Third Prize Winner will receive a Delallo gift collection worth approximately $100. Prizes are non-transferable and non-refundable. Sponsor reserves the right to substitute prize of equal or greater value in the event of prize unavailability.

6) DRAWING & NOTIFICATION:
The Winners will be notified approximately three (3) weeks after the end date of the Promotion. Winners will be notified by the using the contact information they provided when entering. The Grand Prize Winner will be required to execute and return an Eligibility Verification, Liability and Publicity Release Form (where legal) within fourteen (14) calendar days of notice. If any winner cannot be reached within five (5) calendar days from the first notification attempt, or if he/she fails to return any requisite documents within the specified time period, or is not in compliance with these Official Rules, such then such person shall be disqualified and, at Sponsor’s sole discretion, the prize may be awarded to the next-highest-scoring entrant. Prizes will be fulfilled by the Sponsor.

7) PRIZE CONDITIONS:
Prize winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. Winners agree to allow the sponsor to use their name, image, city, and state in publicity initiatives, in perpetuity, without further permission or compensation.

8) INTERNET LIMITATIONS OF LIABILITY:
If for any reason this Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process (if applicable), and to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to an entrant’s system which is occasioned by participating in this Promotion or by downloading any information necessary to participate in the promotion. Sponsor also is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of the entries in the Promotion. If any provisions of the Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding the identity of an individual who actually submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account. "Authorized account holder" is defined as the natural person who is assigned to an e-mail account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, ONLINE OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE CONTEST OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSORS ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.

9) TERMS & CONDITIONS:
This Promotion is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Promotion Administrator, and waive any right to claim ambiguity in the Promotion or these Official Rules. All entrants expressly agree to permit the Sponsor to use entrants’ names, addresses and contact information for marketing purposes, including, but not limited to direct mail and e-mail. Winners and entrants also expressly agree to release, discharge, indemnify and hold harmless the Sponsors including any of its subsidiaries or related companies, vendors associated with the Promotion, and the respective officers and employees of these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Promotion. Any person attempting to defraud or in any way tamper with the Promotion mechanics and/or implementation will be prosecuted to the full extent of the law. The Sponsor may prohibit any entrant or potential entrant from participating in the Promotion, if at the sole discretion of the Sponsor, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or their agents or representatives; or (2) in any other disruptive manner.

This Promotion is void where prohibited.

10) WINNERS LIST:
To request the name of the Prize winners, please send a self-addressed, stamped, business-size envelope to: “Italian Groceries For A Year” Contest, 620 Park Avenue, #332, Rochester, NY 14607. Requests must be received by April 31, 2010.

11) OFFICIAL RULES BY MAIL:
